Anatomy of A Medical Malpractice Lawsuit

Credits: 1.5 Hours Substantive and 0.5 Hours Ethics

Topic: An estimated 70 percent of physicians are named in medical malpractice cases at some time in their careers. This CLE/CME will provide the fundamental aspects of medical malpractice lawsuits, with a focus on the role and perspective of the physician. After an overview of medical malpractice filing and procedure, attorneys from both sides will present their perspectives. Issues during the Discover phase, with an emphasis on the use of medical records, will be explored. We will also address the interplay of the malpractice insurance carrier with both sides. Ethics will be interwoven in the presentations; among the topics to be covered are full disclosure by client to counsel, physician communication with a patient who has filed suit, and appropriate demeanor and answering questions at deposition.
